Copyright Dispute Policy

In compliance with the Digital Millennium Copyright Act, or DMCA (available at https://www.copyright.gov/legislation/dmca.pdf), TrustFinance has established the following general policy against copyright infringement. This policy includes the address of TrustFinance's Designated Agent to Receive Notification of Claimed Infringement ("Designated Agent").

TrustFinance's policy is to (1) prohibit access to or remove anything that it believes, in good faith, has been illegally reproduced and disseminated by any of our advertisers, affiliates, content providers, members, or users; and (2) remove and terminate service to repeat offenders.

1. Procedure for Reporting Copyright Infringement

If you suspect any material or content on or accessible through the Services violates a copyright, please email a copyright infringement report to the Designated Agent specified at the conclusion of this policy:

a.A physical or electronic signature of a person authorized to act on behalf of the owner of the allegedly infringed copyright;

b. Identification of infringing works or materials;

c. Identification of the allegedly infringing content, including information about the location of the infringing items that the copyright owner wishes to have deleted, in sufficient detail for TrustFinance to locate and verify its existence;

d. The notifier's contact information, including address, phone number, and, if available, email address;

e. A declaration by the notifier that the content mentioned in (3) is not allowed by the copyright owner, its agent, or the law; and

f. A statement made under penalty of perjury stating that the information supplied is correct and that the notified party is authorized to file the complaint on behalf of the copyright owner.

Once the Designated Agent receives Proper Bona Fide infringement notification, TrustFinance's policy is:

a. removing or restricting access to the infringing material;

b. to notify the content provider, member, or user that access to the material has been removed or disabled; and

c. that repeat offenders' infringing material will be deleted from the system, and TrustFinance will terminate such content provider's, member's, or user's access to the Service.

Procedure to Supply a Counter-Notice to the Designated Agent

If the content provider, member, or user thinks the material that was removed (or to which access was disabled) is not infringing, or if the content provider, member, or user thinks it has the right to post and use such material from the copyright owner, the copyright owner's agent, or as required by law, the content provider, member, or user must send a counter-notice containing the following information to the designated agent listed below:

a. The content provider's, member's, or user's physical or electronic signature;

b. Identification of the item that has been removed or to which access has been restricted, as well as the position where the material appeared prior to removal or restriction;

c. A declaration indicating the content provider, member, or user believes the material was deleted or blocked due to a mistake or misidentification of the material; and

d. The name, address, phone number, and, if available, email address of the content provider, member, or user, along with a statement that the person or entity consents to the jurisdiction of the Federal Court for the judicial district in which the content provider, member, or user's address is located, or, if the address is outside of the United States, for any judicial district in which TrustFinance is located.

The original complaining party may get a copy of the counter-notice if it is received by the Designated Agent, in which case TrustFinance may restore the deleted content or stop disabling it in 10 business days. The removed content could be updated or accessibility to it might be restored in 10 to 14 business days or more following receipt of the counter-notice, at TrustFinance's discretion, unless the copyright owner initiates a lawsuit asking for a court order against the content provider, member, or user.
